Privacy and Code of Ethics

The Friends Foundation recognizes its obligations to respect privacy and is committed to protecting the privacy of the Personal Information of its employees, volunteers, donors, potential supporters and other stakeholders.

Purpose

  • The Friends of the Moncton Hospital Foundation’s Code of Ethics is based on the standards in two categories of Imagine Canada’s framework: Fundraising, and Financial Accountability and Transparency.
  • This policy provides a reputable framework to follow for establishing and maintaining sound, open, and trusted relationships with donors and the public through ethical fundraising and financial accountability practices.

Scope and Limitations

  • Applies to Foundation Board and Standing Committee members, the President & CEO, employees.

Roles and Responsibilities

  • The Board ensures the framework is approved and serves as the point of reference for all ethical considerations related to fundraising and financial accountability.
  • The Foundation’s Governance and Nominations Committee ensures that operational, fundraising, and financial practices are established and monitored to ensure compliance with the Code of Ethics standards.
  • The President & CEO ensures that the Foundation’s operational, fundraising and financial activities comply with the approved practices established in the Code of Conduct.

Donor Policies and Public Representations

  • The Foundation will always maintain its charitable status.
  • The Foundation will issue receipts for all gifts in compliance with all regulatory requirements. It will also issue charitable tax receipts for all eligible donations above minimum amounts as set by Foundation policy.
  • All fundraising solicitations by or on behalf of the Foundation will disclose the Foundation’s name and the purpose for which funds are requested. Printed and on-line solicitations, however transmitted, will include the Foundation’s address and/or other contact information.
  • The Foundation will demonstrate the utmost transparency and accountability through accurate and accessible disclosure of information in a readily accessible location on its website, including but not limited to
    • the Foundation’s most recent three (3) years of annual reports and financial statements, including notes, as approved by the Board
    • the Foundation’s Business Number as assigned by Canada Revenue Agency (CRA),
    • the names of the Foundation’s Board members, and
    • a copy of this Code of Ethics.
  • The Foundation, or those fundraising on its behalf, will disclose upon request whether an individual or entity soliciting contributions is a volunteer, an employee, or a contracted third party.
  • The Foundation will not make claims that cannot be upheld or are misleading.
  • Where there is concern and it may be warranted, the Foundation will encourage donors making a gift of significant value to their estate to seek independent legal and financial advice.

Privacy

  • When a donor does not wish to be publicly identified as a supporter of the Foundation and/or have the amount of their contribution publicly disclosed, the Foundation will honour their request.
  • Any personal records the Foundation maintains will be kept secure and confidential to the greatest extent possible.
  • Donors have the right to see their own donor record and to challenge its accuracy.
  • The Foundation will not share its fundraising lists with other entities for the purpose of fundraising that does not directly or indirectly benefit The Friends Foundation’s mandate or programs.

Fundraising Practices

Respect

  • The Foundation will make every reasonable effort to ensure that donors and prospective donors are treated with respect, fairness, and in accordance with all applicable law when being solicited by or on behalf of the Foundation.
  • The Foundation will be inclusive when describing the community and people it serves, whether in graphics, images or text, and will fairly represent their needs and how these needs will be addressed.
  • Fundraising solicitations made on behalf of the Foundation will be truthful and accurately describe the Foundation’s activities and, where appropriate, the intended use of donated funds.
  • The Foundation will honour requests to
    • limit the frequency of solicitations
    • not be solicited by telephone or other technology
    • not receive printed material concerning the Foundation, and
    • discontinue solicitations where it is indicated they are unwanted or a nuisance.
  • When the Foundation conducts face-to-face solicitations, including but not limited to door-to-door campaigns or street-side fundraising, its practices will include measures to
    • provide verification that the person represents the Foundation
    • secure and safeguard any confidential information—including credit card information—that donors provide in person
  • The Foundation will make every reasonable effort to ensure that parties who solicit or receive funds on behalf of the Foundation will
    • disclose immediately to the Foundation any actual or apparent conflict of interest, and
    • not accept donations for purposes that are inconsistent with the Foundation’s objects or mission.
  • The Foundation will post its complaints process and related contact information in a readily accessible location on its website.

Financial Practice and Transparency

  • All donations will be used to support the Foundation’s objects, as registered with Canada Revenue Agency.
  • The Board will regularly review the cost-effectiveness of the Foundation’s fundraising programs.
  • The Foundation will establish an Investment Policy setting out principles and procedures for matters such as allocation, investment decisions, and asset protection.
  • The Foundation will provide, upon request, its best available information on the gross revenue, net proceeds, and costs of any fundraising activity it undertakes, including the fundraising costs categorized as education and/or public awareness.
  • The Foundation will not, directly or indirectly, pay finder’s fees, commissions, or compensation based on a percentage of funds raised for fundraising or charitable giving.
